You definately cannot Snap Shot Psychic Shooting attacks.
You dont need to roll to hit with Mind War.
You get Cover and Invulnerables against it. If I had to rule, I would say you can Look Out Sir as there is no rules preventing it.
From a fluff perspective, it makes no sense, but this is GW.

So this is what I got to send to Reece tomorrow.
1. Do Necron inside of Night Scythes take the Str 10 hits when the Night Scythe is blown up? How is morale and Pin checks determined?
2. If stunned/shaken or if it Jinked in the previous turn, does a Storm Talon still need to shoot Snap Shots if it switches to Hover Strike Mode? Or can it even switch to Hover Strike Mode?
3. If the passengers inside of a vehicle shoot but not the vehicle itself, can the vehicle still Flat Out?
4. Can you Look Out Sir Mind War?
5. Can you man an opponents gun emplacement? Can you shoot an opponents gun emplacement if someone is already in base contact with it?

Can an IC (thats part of a unit) who refuses to accept a challenge still be forced to take armor saves or be killed outright by wounds which roll over onto him if there isn't anyone else left in the unit?

I would say yes to this, he just doesn't get to participate or have any of his stats or rules be used. he techinically is part of the squad still, just none of his effects work.
I can add that to the list though.

Considering there we're any figures in Base to Base with the IC it wasn't considered an option by the players. However I for need to know for sure how to rule it in the future

This is how I see it. They are played like units who aren't within 2'' of someone in base. They go to the back of the fight and unable to participate. You can't use their rules or LD. they cannot fight.
Example:
John assaults me with 30 boyz. only 10 can fight. If I do 15 wounds and he fails 12 of them, do 12 die? Well sure, just because 2 of them couldnt fight doesnt mean I can't kill them.
It would be the same thing with the IC or other characters. just because they are ineligible to fight doesn't mean they are not part of the squad or not immune to taking damage.

so how wood that work for some one like Mad doc for ins tins . once he joins a unit he can never leave and they get all of his perks he treated as if he came with the unit? this is not considring any chalinges just that he was out of the 2" rang bit.

being out of range is different than refusing a challenge. if you are out of range you can't fight, but still get to use LD and his rules.
Refusing a challenge does not allow the use of the Ld or the rules of the character.

ICs who are in a unit are considered part of the unit for all intent and purposes. They are considered characters when inside of a unit.

Mark, after reading the BRB on this again i would say yes the character could still be wounded. The only restrictions is that he cannot attack, he cannot use his leadership. Also, nowhere does it say in the rules that you move a model in a challenge UNLESS it is accepted. Then you move them to base contact.
The point im making there is Wounds must be allocated to models in base contact first. SO...if i deal 10 wounds and kill 3 marines and the captain is next you would have to start look out sir ' ing. Seeing as he would be the next in base 2 base.
So i do not believe you have to wipe 30 boys before you kill the warboss IF he is closer than the back of the assault.

I wrote reece and him and the FLG Crew wrote me back. This is what they had to say as far as rules go:
So I talked with my group and I wanted to get questions from them as to what they wanted to know as far as rules go for BAO. Hopefully this will help you guys a little as you won’t be getting a million emails from just my group. Whatever you guys decide is great for me and my group, we would just like a decision either way. So here are the questions: 1. Obviously, this is up on your website, but I will ask anyway. What happens with the embarked units on Night Scythes? Do they take hits? Do they take morale and LD? Do they get RP?
By RAW, they should take the hit, we are still in the process of deciding if they will or not as it is pretty obvious that they are not intended to according to the fluff. We are most likely going to rule that they do, but do not take RP or Morale/Pinning checks. That may change, but that is where we are at now.
2. If stunned/shaken or if it Jinked in the previous turn, is a Storm Talon still forced to shoot Snap Shots if it switches to Hover Strike Mode? Or can it even switch to Hover Strike Mode? This is a question because the Jink rules applies to fliers having to Snap Shot, but the Storm Talon ceases to be a flyer when it goes to Hover Strike Mode.
We are ruling that they do not have to snap fire in the next turn as they are no longer acting as a flyer.

If the passengers fire, the vehicle can not move flat out.
4. Can you Look Out Sir Mind War?
Yes you can LoS! Mind War wounds.
5. Can you man an opponents gun emplacement? Can you shoot an opponents gun emplacement if someone is already in base contact with it?
Yes you can shoot an opponent's gun, and yes, you can shoot it even if another (possibly enemy) model is in contact with it.
6. What models from Forgeworld that are not Gargantuan Creatures or Super heavies or Apoc only are restricted? I know some tournaments outlaw the Cestus and others. Just checking to see what you guys may outlaw, if any.
No restrictions. You can use Baddab war characters, the Cestus, etc. if you want to.
Again, Reece and crew, we really appreciate the time and effort you guys are putting into everything. I am sure you guys are bombarded with emails on a daily basis about this or that. So we appreciate you guys taking the time to answer such questions and making your event the best it can possibly be.
